Terms and conditions.
Hello Food Trucks (HFT) is a division of Here Comes The Truck Pty Ltd ABN 47611569049. HFT operates as a booking agency between you (the Client) and the Food Truck Vendor(s) (Vendor or Vendors) that the Client has agreed to engage.
HFT will then liaise with various vendors to meet the requirements, by and large, that the Client has provided in the Book Me A Food Truck form on the hellofoodtrucks.com.au website.
HFT will then contact the Client with a choice of Vendors to which the Client can agree (including any subsequent changes), or not. Upon selection of a vendor payment of the $100 (incl. GST) Booking Fee will be activated. The Booking Fee is non-refundable. If the Client continues communications and wishes to go no further that closes the request to book a food truck, and earned fees may be charged at the discretion of HFT.
Where the Client agrees with the choice of Vendor, HFT will then prepare emails setting out all the relevant particulars relating to the event (date, location, food to be served, price etc) to be confirmed by the Client. Once confirmed these particulars will be communicated by HFT, as detailed by the client, to the Vendor.
HFT accepts no liability (including loss or damage, whether direct or indirect) for any act, omission or default, whether negligent or otherwise of any provider or third party.
By accepting these Terms and Conditions you acknowledge that you are over the age of eighteen (18) years.
HFT typically responds to the Client with a choice of Vendor in a matter of days but generally within a period of 10 days.
Changes:
In the event the Client is forced to change the date, venue and/or location of the event due to the unforeseen reason, excluding a "change of mind”:
Every effort will be made by HFT to transfer location reservations, Vendors, sub-contractors and HFT support to meet the requirements of the Change.
If required because of the Change, HFT will make all reasonable efforts to find alternative suppliers but it cannot be held responsible for any such Vendor’s performance or product.
Where a Change occurs the Client;
Will Contact any Vendors they have contracted themselves and negotiate meeting the requirements of the Change.
Promptly pay any additional costs incurred in moving vendors in accordance with the Change including but not limited to non-refundable and non-transferable deposits and fees related to the Change and any additional charges above and beyond those set in the original communications.
Understand any such Change can impact the quality of the event and that HFT is not responsible for these compromises in quality.
If, because of the Change, HFT is unavailable to provide services, HFT is released from all contractual obligations and will in no way be held responsible or liable for non-performance. The Client also forfeits all costs for non-compliance with this Agreement.
Any Change must be made in writing and agreed to by all parties.
Payment Terms are as follows:
The Booking Fee of $100 is to be paid within 7 days of the date that Client confirms via email to secure the date and the Vendor. HFT will issue an invoice for this amount and the Vendors cost, and the Client agrees to payment of this amount.
A 30% deposit is to be paid within 7 days from the date that the Client receives the invoice to secure the date and the Vendor.
The final payment of 70% is to be made no later than 14 days before the date of the event.
The 30% deposit and final payment of 70% cannot be refunded because the Client has changed their mind. Nevertheless, depending upon the circumstances, HFT will try to negotiate with the Vendor on your behalf for a refund, if any, but cannot provide a guarantee that there will be a refund, in full or part.
If the event is planned within 7 days of the date that the online Booking form is submitted, payment must be made in full on the date that the Client signs the Food Service Agreement.
Cancellation:
In the event of a cancellation by the Client, refunds are limited to unearned fees. The Booking fee and Vendor Deposits are non-refundable, and any earned fee will have to be paid in full within 14 days of cancellation.
HFT as a Booking Agency and intermediary between the Vendor and Client accepts no liability in relation to the goods or services supplied by the Vendor to the Client.
